The Social Security Administration Backlog
Nothing can be more frustrating to my clients than the length of time it can take to get their Social Security Disability case heard.?? The system is so incredibly backlogged.?? The majority of deserving applicants are denied benefits on their initial application.?? And depending on where??the disabled individual lives, it is not unusual for a person to have to wait??18 months for a hearing before a judge after??the initial disability application has been denied.?? During that time, the disabled individual's bills pile up.????They lose their health insurance because they aren't working.?? They lose their life savings. Sometimes, they lose their homes.
As an attorney, I try my best to develop??Social Security's??paper file on my client's case so that I can ask that a judge take a look at the case "on-the-record."?? In other words, I ask a judge to take a look at my client's file to see if that judge can award my client benefits without having a hearing.?? This is about the only way to get a decision any faster than waiting??our turn for a hearing.?? ??However, many cases cannot be decided on paper, no matter how hard we try, and we just have to wait for the hearing.
